Terms and Conditions

PAYMENT

Payment is due on the day of service unless otherwise noted within the Invoice or Proposal. Payments not received in full on the day of service are subject to a late fee and/or interest. Unpaid invoices after 30 days are subject to collections which include, but are not limited to, Property Lien, Civil Court, and reporting to national collection agencies. Work will be scheduled upon receipt of deposit as outlined in the Proposal. Any sums due after 30 days will incur interest charges of 24 percent per annum, compounded monthly. All Work performed by us shall be completed in a workmanlike manner according to standard landscaping practices and applicable municipal codes. We reserve the right to withhold any future work or warranty service at any point if payment is not made in full.

OWNER’S PRELIMINARY REQUIREMENTS

Prior to commencement of Work, the Owner shall, at their sole cost: complete engineering or survey plans if required; obtain required municipal permits; and provide a work site capable of permitting our Work to occur without ancillary steps (such as clearing existing heavy debris, pet waste, or personal items) not explicitly identified in the Proposal. Owner’s failure to meet these conditions shall constitute a breach of this agreement.

COMPLETION AND DELAYS

We will complete the Work as quickly as practicable. However, Bolawn Landscape Services LLC shall not be responsible for damages arising from delays caused by weather, supply chain issues, or unforeseen site conditions. Work dates are subject to change due to these circumstances and will be rescheduled in a timely manner.

DAMAGES

Owner agrees that the only damages that may be brought against us relate to our failure to complete contracted work or direct damage to property caused by our negligence. Our damages for Owner breach shall include lost profits, mobilization costs, and reasonable attorneys' fees associated with collection or legal action.

TERMINATION

We may terminate the contract for cause (non-payment) or if site conditions identified after commencement make the work impractical. Owner may terminate prior to completion but shall pay for all completed Work, specifically purchased materials, and incidental damages as outlined above.

USE OF PHOTOGRAPHY

Owner agrees to allow Bolawn Landscape Services LLC to use photographs of the completed work for promotional and advertising purposes without fees or penalties.
